These Terms of Service ("Terms") govern your use of the services provided by Listhive LLC ("Listhive," "we," "us," or "our") through listhive.co and any related platforms. By purchasing or using our services, you agree to these Terms.

1. Services

Listhive provides B2B verified contact lists and lead generation data for sales teams and businesses. Our services include curated prospect lists, contact verification, data enrichment, and related lead generation deliverables as described in your selected package.

2. Packages and Pricing

We offer one-time purchase packages and custom list options. Current pricing is listed on our website and may be updated at any time. Packages include:

• Starter List ($99): 250 verified contacts in your target niche, including name, email, company, and title.
• Growth List ($249): 750 verified contacts with enriched data — phone numbers, LinkedIn profiles, company size, and revenue estimates.
• Enterprise List ($499): 2,000+ verified contacts with full enrichment, custom filtering, and priority delivery within 24 hours.

3. Payment Terms

All payments are processed securely through Stripe. Payment is required before list delivery. For custom orders, we may require a 50% deposit before work begins with the balance due upon delivery.

4. Delivery

Lists are delivered as CSV files via email within the timeframe specified for your package (typically 24-72 hours). Custom enterprise orders may take up to 5 business days. Delivery timelines begin after payment is confirmed.

5. Data Accuracy and Guarantees

We verify all email contacts before delivery and guarantee a minimum 90% deliverability rate. If more than 10% of emails bounce within 30 days of delivery, we will replace the invalid contacts at no additional charge. This guarantee applies to hard bounces only, not soft bounces or spam filters.

6. Acceptable Use

You agree to use our data in compliance with all applicable laws, including:

• CAN-SPAM Act (United States)
• GDPR (if contacting EU residents)
• CASL (if contacting Canadian residents)
• Any other applicable anti-spam or data protection regulations

You may not resell, redistribute, or sublicense our contact lists without written permission. Each purchase grants a single-use license for your organization's direct outreach purposes.

7. Refunds

Due to the nature of data products, all sales are final once a list has been delivered. If we are unable to deliver a list meeting the agreed specifications, we will offer a full refund or replacement list at your choice. Refund requests must be made within 7 days of delivery.

8. Limitation of Liability

To the maximum extent permitted by law, Listhive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our data. We are not responsible for the outcomes of your outreach campaigns. Our total liability shall not exceed the amount you paid for the specific list in question.

9. Indemnification

You agree to indemnify and hold harmless Listhive, its officers, employees, and agents from any claims, losses, or damages arising from your use of our data, including any violations of anti-spam laws or data protection regulations.

10. Intellectual Property

Our data compilation methods, scoring algorithms, and verification processes are proprietary. Your purchase grants you a license to use the delivered data, not our methods or tools.

11. Modifications

We may update these Terms at any time. Material changes will be posted on our website. Continued use of our services after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
